These Terms of Service ("Terms") govern your use of the Kensic mobile application and website (kensic.app), operated by Kensic LLC ("we," "our," or "us"). By using Kensic, you agree to these Terms.
You must be at least 13 years old to use Kensic. You are responsible for maintaining the security of your account credentials and for all activity under your account.
Kensic offers a 10-day free trial of all premium features. After the trial, premium features require a paid subscription.
Subscriptions automatically renew unless cancelled before the end of the current billing period. You can cancel anytime through the app, your Stripe customer portal, or your device's subscription settings (Google Play / App Store).
Payments are processed securely through Stripe, Google Play, or the Apple App Store, depending on your platform and payment method. All prices are in US dollars. We do not store your payment card details.
If a payment fails, your subscription may enter a grace period during which the payment provider will retry the charge. The length of this grace period varies by provider. If payment is not resolved, your subscription will be cancelled.
If you are unsatisfied with Kensic Premium, you may request a refund within 14 days of your initial purchase by contacting support@kensic.app. Refunds for renewal charges are handled on a case-by-case basis.
For purchases made through Google Play or the Apple App Store, refunds are subject to their respective refund policies.
You retain full ownership of all content you create in Kensic (people, activities, frames, notes, etc.). Your content is stored locally on your device — we do not have access to it, and we claim no intellectual property rights over it.
You are solely responsible for the content you create and for maintaining backups of your local data.
Kensic uses Bluetooth Low Energy (BLE) to enable nearby device communication through its Broadcast and Meld features. By enabling Broadcast, you consent to your device transmitting an encrypted, anonymized identifier that can be received by other nearby Kensic users. You can disable Broadcast at any time in the app's settings. You are responsible for the content you share with other users via Meld.
You agree not to:
Kensic classifies content into three maturity tiers:
Maturity classification is performed through a combination of automated classification and human review. By enabling mature or adult content in your settings, you confirm that you are 18 years of age or older. Kensic does not moralize about legal adult activity — content is classified for the purpose of age-appropriate access, not censorship.
Content classified as illegal — including but not limited to CSAM, targeted violence, and content facilitating harm to minors — is blocked and may be reported to authorities regardless of maturity settings. Kensic reserves the right to classify, reclassify, or remove any user-submitted content at its sole discretion.
We reserve the right to modify, restrict, or revoke access to features based on safety, security, and community guidelines.
Content moderation: User-submitted interests, activity names, and other text content are reviewed through a multi-level moderation pipeline that includes automated classification, AI-assisted review, and human oversight. Content that violates our policies may be removed or reclassified without notice.
Community reporting: Kensic includes content reporting tools that allow users to flag content they believe is harmful, inappropriate, or illegal. When you submit a content report, we may collect the reported data, its origin metadata (including the sender's user identifier), and your description of the concern. Reports related to the safety of minors are treated with the highest priority and may be escalated immediately.
Photo safety scanning: All images uploaded to Kensic (including Pulse activity photos, neighborhood photos, and place photos) may be subject to automated scanning against databases of known child sexual abuse material (CSAM) using perceptual hash-matching technology. This scanning compares a mathematical fingerprint of the image — not the image content itself — against databases of previously identified illegal material. User-uploaded photos are also subject to community flagging; photos that receive multiple flags may be automatically hidden pending review.
Action on illegal content: If a match is detected or content is reported as potentially illegal:
Law enforcement cooperation: Kensic is a registered Electronic Service Provider with NCMEC. We cooperate fully with law enforcement agencies investigating child exploitation, and may provide NCMEC and law enforcement with relevant data including the content itself, the associated user account information (user ID, email address, IP address), upload timestamps, and geolocation data.
User bans: Users who violate these Terms, particularly regarding illegal content or the safety of minors, may have their accounts suspended or permanently banned. Ban decisions are made by Kensic administrators following review of available evidence.
By using Meld to share data with other users, you acknowledge that recipients may report shared content and that such reports may be reviewed by Kensic.
The core Kensic app works offline on your device and does not require an internet connection. Cloud-based services (authentication, subscription management, and optional backup) depend on third-party infrastructure. We strive to keep these services available but do not guarantee uninterrupted access.
You may stop using Kensic at any time by deleting the app and cancelling your subscription. We may suspend or terminate your account if you violate these Terms. Termination of your account revokes access to premium features and cloud services only — your locally stored data remains on your device and is unaffected.
To the maximum extent permitted by law, Kensic is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the app.
We may update these Terms from time to time. We will notify you of material changes through the app or via email. Continued use after changes constitutes acceptance.
These Terms are governed by the laws of the State of Minnesota, United States. Any disputes will be resolved through binding arbitration in accordance with applicable rules.
